End User License Agreement

IMPORTANT - READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Niche Worlds Cult, LLC for the use of the online game software and related services provided by Niche Worlds Cult, LLC. By installing, copying, or otherwise using the software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the software.

1. License Grant

Niche Worlds Cult, LLC grants you a non-exclusive, non-transferable license to use the software for personal, non-commercial purposes only. The license is limited to use on one account per user, and you may not distribute, sell, or transfer the software or account to any third party.

2. User Content

You grant Niche Worlds Cult, LLC a non-exclusive, royalty-free license to use, reproduce, modify, and distribute any player data you generate for the purposes of operating and improving the game, and promoting Niche Worlds Cult, LLC.

3. Intellectual Property

The software and all intellectual property rights related to the software are the property of Niche Worlds Cult, LLC or its licensors. You may not copy, modify, distribute, or create derivative works based on the software or any part thereof.

4. Terms of Service

Your use of the software is also governed by the Niche Worlds Cult, LLC Terms of Service, which are incorporated into this EULA by reference. You agree to comply with the Terms of Service and any additional rules and guidelines provided by Niche Worlds Cult, LLC.

5. Disclaimers and Limitation of Liability

The software is provided "AS IS" without warranty of any kind, either express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. In no event shall Niche Worlds Cult, LLC be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the software, even if Niche Worlds Cult, LLC has been advised of the possibility of such damages.

6. Termination

Niche Worlds Cult, LLC may terminate this EULA at any time for any reason. Upon termination, you must immediately cease all use of the software.

7. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the state of Wyoming, without regard to its conflicts of law principles.

8. Entire Agreement

This EULA constitutes the entire agreement between you and Niche Worlds Cult, LLC regarding the use of the software and supersedes all prior or contemporaneous agreements or understandings, whether written or oral.
